Rental Hire Bookings, Payments and deposit terms and conditions
This Statement outlines the terms and conditions governing all sales and purchases made through this website, regardless of whether the order was transmitted via the internet, telephone/fax, or post. By accessing, browsing, and/or using this site you acknowledge that you have read, understood, and agree to be bound by these terms and to comply with all applicable laws and regulations. If you do not agree with these terms, do not use this site.
Shop Orders
Our website shows stock availability online within the product pages and also on the category pages. The following stock statuses are shown:
In Stock
This means that Big Noise currently have this product available at our Hastings showroom and is available for courier or/and click & collect purchase.
Available on Backorder
This means that Big Noise does not currently have this product available at our Hastings showroom, but we are able to place a backorder with our supplier for the product requested. Please call us for an ETA on 06 876 9661 if you wish to place a backorder. We offer a refund minus payment processing fees if our supplier is unable to fulfill the order.
Shipping Information
Orders placed and paid for before 2pm, Monday to Friday, are guaranteed to be dispatched the same day. Orders placed after 2pm may still be dispatched the same day depending on order volume, but if not they will be dispatched on the following business day.
All of our deliveries are shipped via NZ Post. NZ Post has an overnight delivery target for all major towns and cities and you can reasonably expect your package to arrive on the following business day. However please be aware that we cannot guarantee overnight delivery, only that we will get your package to New Zealand Couriers in time for them to meet their target. Rural addresses are not eligible for overnight delivery, and an extra 1-2 working days should be allowed.
You will receive an email with a tracking number once your order is physically in the hands of NZ Post. You can track the status of your package using the link provided in the email you will receive from us.
Surcharges
BigNoise Group Ltd charges a surcharge on some payment options offered to its customers. This is done to offset the costs charged to BigNoise Group Ltd by the payment provider (e.g. credit card or finance companies) when a customer uses these payment methods.
How much is the surcharge?
Where a surcharge applies, it can vary based on the payment method used, but for credit card transactions it is 2.5% and for some 3rd party finance transactions 1 to 5%. The exact amount of any surcharge is clearly displayed during the checkout process of this website.
Avoid paying surcharges?
You can pay in-store using EFTPOS.
Pricing
All prices quoted are subject to change at any time at the discretion of Big Noise Group Ltd. You will be charged in New Zealand currency. Big Noise Group Ltd reserves the right to reject any orders which include incorrect pricing, which may occur due to data entry errors, code errors, hacking, incorrect pricing provided by the manufacturer, translation errors, etc. Prices are not negotiable. Postage and handling costs will be calculated when completing the order.
Purchases made through our website may differ to purchases made in-store at our Hastings showroom.
Specials
Specials are subject to availability while stocks last.Big Noise Group Ltd does not allow backorders for specials that are out of stock.
Payment Methods
Payment for online orders can be made via Credit Card, Bank Transfer, Afterpay, Genoapay, Gem Visa, Q Card or Online Eftpos (selected banks only). Transactions made via Credit Card will appear on cardholder statements as "BIG NOISE GROUP LTD"
Warranties
All goods sold by us warranted against manufacturing defect(s) (parts) (provided the item purchased has been installed/used in accordance with the manufacturer’s specification) only on a back to base basis unless specified otherwise and is approved by the manufacturer.
If the goods are faulty we will meet our obligations under the Consumer Guarantees Act to provide a remedy. We will repair and/or replace faulty goods, but won’t necessarily refund them unless we are unable to repair or replace. It’s at the sole discretion of the manufacturer to approve all warranty claims. Misuse & Abuse, accident & product modification is not covered under warranty.
Goods sent back must be shipped at the owner’s expense and proof of purchase must be provided. Any goods being returned for warranty must be in their original condition and original packaging with all accessories. This includes, components, manuals, cables, documents (etc).

Returns & Refunds
We do not have to provide a refund for change of mind about a particular purchase, so please choose carefully. Big Noise also reserves the right to refuse a refund for an incorrect item/product purchased by yourself without prior consultation. If you are unsure about which product you require, please utilize our live-chat service or give us a call to avoid ordering the incorrect product.
Once your order has been placed your order cannot be cancelled. Customers are liable for every order made.
If you have a problem with your purchase, then you’ll require an RA (Return Authorization) number, which can be obtained by contacting our sales team. We will then contact you and you will need to send it back to us or directly to the supplier. Returns must be in their original condition and original packaging with all accessories (includes, components, manuals, cables, documents etc) at your own freight cost. You can view more information about our warranties above.
An item returned for a replacement may be repaired or replaced at Big Noise Group discretion, unless otherwise required by law.
In the event we agree to a return of goods, a re-stocking fee of 35% of the purchase price will be charged. No returns will be accepted where they have been fitted or used or in a soiled condition (including packaging, components, manuals, cables, documents etc). Returned goods will not be accepted after seven days from the date of delivery. Freight on returns is to be prepaid. Physically damaged items cannot be returned.
Product Availability
Every effort will be made to fulfill orders placed with Big Noise, but no employee of Big Noise Group Ltd shall be liable to any person if Big Noise Group Ltd is unable to or declines to supply a product for any reason whatsoever.
Big Noise Group Ltd does not stock all products listed on this site in a single warehouse. All items sold via Big Noise Group website are subject to availability and Big Noise reserves the right not to accept or cancel any order for products that are out of stock. Product availability, information is provided by a number of third party suppliers. Big Noise Group works with these third-parties to ensure this information is as accurate as possible however some errors and omissions are expected. Goods delivered may differ to the product image presented on this site.
Big Noise Group Ltd reserves the right to limit quantities able to be ordered by, or delivered to, customers. If a Customer’s order is reduced in accordance with this clause, the price payable by the Customer for that order will be adjusted accordingly. Big Noise Group Ltd may delay dispatch of the order that exceed reasonable quantities due to stock availability.
Delivery & Freight
All orders are subject to a delivery/freight charge.
We normally ship our products within five working days within New Zealand unless specified otherwise. If we are unable to dispatch your order within five working days we will contact you and advise you of the expected dispatch date.
Upon dispatch we will supply the ticket number for you to track & trace.
If purchases are payment by direct banking we can dispatch the goods within one to two days.
Our products are delivered with insurance when you purchase from Big Noise Group Ltd. In the highly unlikely event that your item arrives damaged, or is lost, let us know, we will arrange for a courier to collect and we will either replace it (if a replacement is available), replace with a similar product of equal or higher value or issue a refund – the choice is at our discretion.
Please check your delivery address carefully as we will not be responsible for delivery to an incorrect address. The customer shall be responsible for the cost to resend a parcel that is returned because of an incorrect address.
ONCE YOUR ORDER HAS BEEN SHIPPED, THE ORDER CANNOT BE CANCELLED.
Suspension or Termination
Big Noise Group Ltd may, at its absolute discretion, suspend or terminate the ability of any Customer to purchase Products through Big Noise Group Ltd Online Shopping for any reason whatsoever.
Trade Not Supplied
Unless otherwise agreed, Customers may not purchase Products through Big Noise Group Ltd Online Shopping for the purpose of resale.
Ownership
When your order is delivered, you acquire ownership of all items. Big Noise Group Ltd will no longer be responsible for any damage inflicted on the items unless it is due to a manufacturing fault which is covered under warranty.

The Customer agrees not to use Big Noise Car Audio Online Shopping for any purpose that is unlawful or prohibited by these terms and conditions. Customers may download the information on the Big Noise Group Ltd Online Shopping, for their own personal use but otherwise neither Big Noise Group Ltd Online Shopping, nor any material on it, may be altered, modified, reproduced, transmitted or distributed without Big Noise Group Ltd prior written consent. The Customer agrees that it will not interfere with any other party’s use and enjoyment of Big Noise Group Ltd Online Shopping, or damage the operation of Big Noise Group Ltd Online Shopping, or Big Noise Group Ltd systems or those of other persons who use Big Noise Group Ltd Online Shopping, whether by way of a virus, corrupted file, any other software or program, or otherwise.

By creating an account with Big Noise Group Ltd you consent to receiving electronic communications from Big Noise Group Ltd. These communications will include account status updates, order status updates, promotional and marketing materials and other information relating to the service. Limitation of Liability
Big Noise is not liable for any direct, indirect, special, incidental or consequential damages arising out of the use, or the inability to use, the material on this site. This includes but is not limited to the loss of data or loss of profit, even if Big Noise Group was advised.

Rental Hirer Terms & Conditions – Bookings, Payment & Deposits:
These Terms & Conditions cover the procedures for the hire of event equipment and services from BigNoise Group ltd. The person or organization that hires the equipment from us is referred to as you, the Client, or the lessee. BigNoise Group ltd is referred to as we, us, the lessor or BigNoise Group ltd. We reserve the right to adjust the terms and conditions without notice and will post the most recent version here on the website.
We will need your full contact details before we will hire to you. Minimum details are First and Last name, phone number, email address and we may ask for your postal address. Both these Terms & Conditions and our Privacy Policy at the bottom of this document are posted on our website.
To confirm a booking, you must make a minimum 50% deposit into our bank account. Please use the quote or invoice number as reference and send us an email confirmation that you have paid us.
Please also note that equipment is not officially booked until at least 50% deposit payment is received. We reserve the right to hire it out to someone else if deposit has not been received.
BigNoise Group ltd works on a strict payment in-advance policy for equipment hire or service. Full payment is required 3 days prior to a delivery, as we need to prepare in advance for your setup. Failure to make full payment by event start time will result in either the delay of delivery until full payment is made or cancellation of the booking at our discretion. We recommend that final payment be made the week prior to the event to ensure the bank clears the payment well in advance of required delivery. BigNoise Group ltd reserves the right to delay or withhold delivery until full payment is made. If we do not receive full payment on the day of required delivery, we reserve the right to cancel the booking and if this happens, then deposit is retained and is nonrefundable.
Established Clients with a history of transactions with us (that is we have been working together more than a year and on more than five events a year) may apply for an exemption to the payment in advance rule. To do so you must have an established purchase order system (for example if you are a school or a council institute). With established clients who apply for this rule exemption, we can work on your billing cycle whether it is within 7 days of invoice or 20th of the Month.
For dry hire pickups or unattended hires, please bring your driver license or passport and your credit card. We will keep these details on file until all the equipment has been returned to us in original condition.
We no longer accept cheques due to cheques being unreliable as a payment medium.
The Company reserves the right to charge interest up to 10% per month on overdue accounts. Should payment in full not be paid within 60 days, legal action will be taken to recover the debt owing without further notice & all credit facilities will be closed. Any expenses, costs or disbursements incurred by the Company in recovering any outstanding debts including dishonored cheques, the Customer shall pay debt collection agency fees and solicitor’s costs. In order to retake possession of the equipment, it shall be lawful for the Company to enter into or upon any premises where the same may be and the Customer hereby agrees to indemnify and to keep indemnified the Company against all liability and against all actions, suits, proceedings, claims, demands, costs and expenses howsoever incurred by the Company arising from the Company’s entry into or upon any premises in exercise of its rights of repossession.
Terms & Conditions – Cancellations
- During our off-peak season (May to Sep Event/Hire) Cancellations within 1 month of delivery will result in loss of deposit. Cancellations made prior to this; we will refund the 50% deposit in full.
- During our peak season (October to April Event/Hire) Cancellations within 2 months of delivery will result in loss of deposit. Cancellations made prior to this; we will refund the deposit in full.
- For Cancellations made within 1 weeks of an event the following fees will apply (including 50% deposit), in order for us to recover preparation and pre-production costs.
- Cancellation within 72 hours to 1 week of event before set up: 70% of the total is due.
- Cancelling between 48 and 72 hours of the event before set up: 80% of the total is due.
- Cancellation in less than 48 hours of event before set up: 100% of the total is due.
- if we have begun setup, then 100% of total is due.
- if we have to Sub hirer in there is no refund.
Terms & Conditions – Postponements:
To reschedule an event sufficient notice must be given. Sufficient notice is at least 1-week notice. With sufficient notice you may be entitled to use 50% of your deposit towards a timely rescheduled event at our discretion. Any rescheduled event is subject to availability at the time of notification of postponement. If there is a postponement of the event due to some unforeseen circumstances such as rain we will do our best to provide you with the hire on your new date, however we reserve the right to decline service if we are unable to make the new date. Deposit and payment will transfer to the new date if we can make the new date, however our terms will remain as per cancellation policies above if we are unable to make the new date. It is therefore best practice to organize a rain date with us in advance if you plan to have one.
It is recommended to discuss and arrange a rain date with us in advance if you plan to have one. A rain date charge will be applied, which includes half the rate for gear or wages, covered accommodation, and labour time travel. The specific details of the rain date charge should be discussed and agreed upon.
Terms & Conditions – Loss or Damage:
Whilst equipment is in the possession of the lessee, the lessee is expected to take all reasonable care and precaution with the equipment. Loss or damage of any hired equipment whilst in the care of the lessee will result in incurring further charges as outlined below:
In the event of loss, damage or theft, the lessee, at the discretion of BigNoise Group ltd shall:
- a) at the lessee’s expense repair the equipment to our satisfaction,
- b) at the lessee’s expense replace the equipment with similar or like, or
- c) make full payment to recover costs of replacement.
We reserve the right to keep the details of your credit card and driver license is as a security on your hire. We will discard these details once the equipment has been returned to us in original condition.
Terms & Conditions – Insurance:
BigNoise Group ltd does not offer insurance coverage for hired equipment. Any loss, theft or damage is the full responsibility of the lessee. BigNoise Group ltd does not provide any insurance coverage for you or for your event. You are responsible for maintaining your own insurances for your event including but not limited to public liability and property damage insurance. Please check your contents insurance policy as you may already be covered for equipment that is on your premises, otherwise you should organise temporary cover for the duration you are in possession of our equipment. You may want to ask the venue owner if hired equipment is insured under their contents policy. If cover is not possible, not available or too expensive then you must take full responsibility as the lessee for any loss, theft or damage incurred. Make sure you follow set-up and operating instructions, employ security, keep the public away from the equipment and hire experienced tech support to operate the equipment.
Terms & Conditions – Noise Control:
If a member of the public complains about the sound levels at your event, you will likely get a visit from Noise Control who will ask you to turn it down. If you are served with an ‘Excessive Noise Notice’, please comply. Noise Control will come back, shut you down and take the gear away, if you do not comply. They may also bring the Police with them. When they do take the gear away there is a Infringement notice to be issued under Resource Management Act (RMA 1991)* $750.00* Return of confiscated equipment (seizure of any property) $145.00 plus our time at $60 an hour to retrieve it from the Police. Hire charges continue until the equipment is returned to our warehouse.
Terms & Conditions – Indemnification Clause:
BigNoise Group ltd carries Public Liability insurance limited to our services and equipment when we are operating it.
The lessee understands that the use of our equipment may involve inherently dangerous activities. Consequently, the lessee agrees to indemnify and hold the lessor (BigNoise Group ltd) harmless from all claims, actions, suits, proceeding costs, expenses, damages and liabilities including reasonable attorney’s fees arising due to damage to property or injury or death to persons, regarding or resulting from the use of said equipment including, but not limited to the delivery, possession, use, operation, or return of the equipment. The lessee hereby releases and holds harmless the lessor from injuries or damages incurred due to the use of said equipment unless lessor is operating the equipment and is deemed by a court of law to be negligent in its actions. Lessor cannot under any circumstances be held liable for injuries due to accidents, nature or other conditions beyond our control or knowledge. Lessee also agrees to indemnify and hold harmless the lessor from any loss, damage, theft or destruction of the equipment during the hire period and any extension thereof.
Terms & Conditions – Late Returns & Penalties:
Any equipment returned after the agreed period of the rental will incur further hire charges at 50% of the per day rate for each additional day it is overdue, OR at a rate of 3x day rate hire per additional week, it is overdue.
